Pathways to British Citizenship for a Child

British citizenship for a child can be acquired through several pathways.Depending on the child’s circumstances, they may become a British citizen automatically or may need to apply for registration. Below is a detailed exploration of the eligibility criteria, legal pathways, and special considerations for children, with references to relevant laws and historical changes.

Citizenship by Birth in the UK

A child born in the UK may automatically acquire British citizenship if

  • At the time of their birth, at least one parent is a British citizen or "settled" in the UK (i.e., holds indefinite leave to remain or permanent settlement).
  • The child was born in the UK on or after 1 January 1983, as stipulated by the British Nationality Act 1981. Children born before this date were classified differently under historical laws

If neither parent was a British citizen nor settled at the time of the child’s birth, the child does not automatically become a British citizen. However, they may have the opportunity to register as a British citizen later if certain conditions are met, such as one parent obtaining settled status or the child living in the UK for a specific period (covered in Section 2).

Legitimacy and Parentage

Before 1 July 2006, children born outside marriage could inherit British citizenship only through their mother. The Immigration, Asylum and Nationality Act 2006 removed this barrier, allowing children born out of wedlock to inherit British citizenship from either parent, provided paternity is proven.

Paternity can typically be established with a birth certificate naming the father or evidence such as DNA tests.
